Welcome to FitNova. These Terms of Service ("Terms") govern your access to and use of the FitNova mobile application, website, and related services (collectively referred to as the "Service") operated by FitNova ("we", "our", or "us"). Please also review our Privacy Policy to understand how we handle your data.

By creating an account, downloading, accessing, or using the FitNova application, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Eligibility

To use FitNova, you must meet the following requirements:

• You must be at least 13 years old.
• Users under 18 years of age must have permission from a parent or legal guardian.
• You must have the legal capacity to agree to these Terms.

By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

Certain features of the Service require creating an account. To use FitNova's automated personalization, you must input sensitive physical parameters. You are responsible for safeguarding your account credentials. We utilize industry-standard encryption to protect your physiological profile. You agree to provide exceptionally accurate and honest physical parameters, as providing false data can cause the AI to generate potentially exhausting or dangerous diet/workout prescriptions.

When creating an account, you agree to:

• Provide accurate and complete information
• Choose a unique username that will be used for chat discovery and identification within the app
• Keep your login credentials secure
• Maintain and update your information when necessary
• Be responsible for all activities that occur under your account

You must immediately notify us if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

3. Description of the Service & AI Generation Liabilities

FitNova is a digital fitness and wellness platform that employs advanced Artificial Intelligence to provide automated, highly specific fitness regimens and nutritional guidelines:

• AI Workout Architect & Master-Curated Routines: The App uses user-provided physiological profiles to generate customized workouts or assigns you to premium curated templates. We do not guarantee the safety, efficacy, or exact results of these routines.
• Auto-Synced Diet Generation & Goal Tracking: The App syncs your daily nutritional targets to your generated workout loop in single-click actions, or generates fallback daily goals. While the AI targets extreme accuracy, the caloric burn rates and dietary requirements are intelligent estimates, not exact medical science.
• Cinematic Food Recognition & Database Search: The X-Ray Food Scanner and our comprehensive food database search leverage machine vision to identify foods and calculate macros. FitNova cannot completely guarantee the absolute accuracy of scanned food volumes, brand-specific hidden calories, or micronutrient exactness.
• Messaging & Leaderboards: The app includes a secure, end-to-end encrypted chat system that allows users to engage in private text conversations and share media, workout plans, and diet/nutrition plans directly with other users. Chat is username-based — users can search for and connect with others by name or username. Users with public accounts are discoverable by anyone; users with private accounts must approve chat requests before conversations can begin. It also includes professional Global Leaderboards to track comparative fitness metrics.

These features may change, improve, or be discontinued at any time.

5. User Safety Responsibility

Users should always exercise safely and responsibly. You agree to:

• Stop exercising immediately if you experience pain or discomfort
• Use proper equipment and form
• Adjust workouts based on your fitness level

FitNova does not guarantee that workouts are safe or suitable for every individual. Proper form and execution remain your sole responsibility.

6. AI and Automated Decision Making

FitNova uses artificial intelligence systems to generate recommendations. Because of the nature of AI systems:

• Results may not always be accurate
• Recommendations may not suit every user
• Nutritional analysis may contain estimation errors

Users should apply personal judgment before following AI recommendations and cross-referencing critical nutritional needs (e.g., severe allergies) is strictly required by the user.

7. Chat & User Generated Content

FitNova includes a secure, end-to-end encrypted chat system allowing users to communicate privately with one another. Users can share text, media, and fitness-related content directly with other users via chat, as well as participate in competitive Global Leaderboards based on verified workout data. By sharing content through the chat feature or participating in leaderboards, you grant FitNova a non-exclusive, worldwide, royalty-free license to use, display, reproduce, manipulate, and distribute your analytical data within the app's internal ecosystem (such as calculating Leaderboard rankings).

End-to-End Encryption: Chat messages are encrypted end-to-end, meaning only the sender and recipient can read message contents. FitNova cannot access, read, or decrypt the content of your private conversations. However, if a user reports a conversation, the reporting user may choose to forward specific messages to our moderation team for review.

Username-Based Discovery: Your username and display name are searchable by other users. If your account is set to "Public," any user can find you and start a chat. If set to "Private," only approved contacts can message you. You can change your visibility setting at any time in the app settings.

You remain the owner of your content but grant us permission to use it for operating and improving the Service.

8. Chat Guidelines & Acceptable Use

Users must maintain respectful behavior when using chat and other interactive features. For a full breakdown of expected conduct, please read our Chat Guidelines. You agree not to send or share content that:

• Harasses, threatens, or abuses others (Zero Tolerance: Harassment, bullying, hate speech, or the promotion of dangerous eating disorders will result in immediate, permanent bans without a refund)
• Contains hate speech or discrimination
• Includes explicit or offensive material
• Promotes illegal activity
• Spreads harmful misinformation about health
• Violates intellectual property rights
• Is spam, scam, or misleading advertising
• Manipulates Leaderboard Integrity: Artificially inflating workout completion metrics or falsifying food logs to manipulate Global Leaderboard standings is prohibited.
• Attempts to circumvent end-to-end encryption or exploit the chat system for unauthorized data collection

FitNova provides in-app tools for reporting objectionable content and blocking users. Users are encouraged to use these tools to maintain a safe chat environment. FitNova reserves the right to review reported content, remove violations, and suspend or permanently terminate accounts that violate these rules.

9. Prohibited Activities

Users may not:

• Reverse engineer or attempt to copy the app's software
• Attempt to hack, exploit, or interfere with the Service
• Use bots or automated systems to abuse the platform
• Attempt to extract or scrape database information
• Upload viruses or malicious code
• Use the app for illegal purposes

Violation of these rules may result in immediate account suspension or termination.

10. Intellectual Property

All intellectual property rights related to the Service belong to FitNova or its licensors. This includes App design, Logos and branding, Graphics and images, Software code, AI models and algorithms, and Databases and content. Users may not copy, modify, distribute, or reproduce any part of the Service without written permission.

11. Subscriptions, Payments, and Refund Policy

FitNova Premium features (such as advanced AI workout plans, personalized diet recommendations, and full scanner access) operate via auto-renewing subscriptions processed directly through the official platforms where the app is downloaded (Apple App Store or Google Play Store).

• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current billing cycle. Users can manage subscriptions through their app store account settings.
• Pricing: Subscription pricing is displayed in-app before purchase. Prices may vary by region and currency. By confirming a purchase, you agree to pay the displayed price.
• Free Trials: If a free trial is offered, you will not be charged during the trial period. Your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. The trial length and applicable pricing will be clearly displayed before you start the trial.
• Cancellations & Refunds: All payments, including refunds, are processed by Apple or Google. We cannot directly cancel your subscription or issue refunds. You must contact the relevant store provider for refund requests.
• Ongoing Value: FitNova Premium subscriptions provide continuous, updated value including new AI-generated workout plans, evolving diet recommendations, ongoing food scanner access, and regular feature improvements throughout your subscription period.

12. Account Suspension, Termination, and Deletion

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, misuse the Service, or if your actions harm other users or the platform.

Users may delete their account and personal data at any time directly from within the app settings, or by contacting our support team via the Help Center. Upon account deletion, all personal data — including profile information, workout history, diet logs, chat metadata, and shared media — will be permanently deleted within 30 days. Some anonymized data may be retained if required by law or for security purposes, as outlined in our Privacy Policy.

Important: Account deletion does not automatically cancel active subscriptions. You must cancel your subscription separately through your Apple App Store or Google Play Store settings before deleting your account to avoid future charges.

13. Service Availability & Changes

We strive to keep the Service available at all times but cannot guarantee uninterrupted access. The Service may occasionally experience downtime due to maintenance, updates, technical issues, or server problems. We may update, modify, or discontinue features of the Service at any time without prior notice.

14. Limitation of Liability

To the maximum extent permitted by applicable law, FitNova and its corporate affiliates, developers, and partners shall not be held liable for any direct, indirect, incidental, physical, or consequential damages resulting from your access to or use of the App. This includes, but is not limited to, physical injury, severe medical complications, eating disorders, property damage, inaccurate AI recommendations, nutritional calculation errors, loss of data, or interactions between users. Use of the Service is at your own risk.

15. Indemnification

You agree to indemnify and hold FitNova harmless from any claims, damages, or expenses resulting from your use of the Service, your violation of these Terms, or your content posted on the platform.

16. Force Majeure

FitNova shall not be responsible for failure to perform obligations due to events beyond our reasonable control, including Natural disasters, Cyberattacks, Power outages, Government restrictions, or Internet failures.

17. Third-Party Services

The Service may integrate with third-party platforms such as payment processors, analytics tools, or AI providers. FitNova is not responsible for the practices or policies of third-party services. Users should review the terms and policies of those services separately.

18. App Store & EULA Compliance

If you downloaded the FitNova mobile application from the Apple App Store or Google Play Store, you acknowledge and agree to the following:

• Acknowledgement: These Terms are concluded between you and FitNova only, and not with Apple Inc. or Google LLC. FitNova, not Apple or Google, is solely responsible for the Licensed Application and the content thereof.
• Scope of License: You are granted a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the FitNova application on any compatible mobile device that you own or control, and as permitted by the usage rules set forth in the respective App Store Terms of Service.
• Maintenance and Support: FitNova is solely responsible for providing any maintenance and support services for the application. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
• Product Claims: FitNova, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the application or your possession and/or use of the application, including: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
• Intellectual Property Rights: In the event of any third-party claim that the application or your possession and use of the application infringes that third party’s intellectual property rights, FitNova, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• Legal Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: You acknowledge and agree that Apple, Google, and their respective subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable laws and regulations. Disputes arising from these Terms may be resolved through arbitration or appropriate legal processes where permitted by law.

20. Changes to These Terms

FitNova reserves the right to update these Terms periodically. If changes are made, the updated Terms will be posted within the app or on the website with a revised effective date. Continued use of the Service after changes means you accept the updated Terms.
