Welcome to FitNova. These Terms of Service ("Terms") constitute a legally binding agreement between you and FitNova ("we", "our", or "us") governing your download, access, and use of the FitNova mobile application (the "App"), our website, and associated services (collectively, the "Service").

Please read these Terms carefully before using the Service. Your privacy and personal data protection are also governed by our Privacy Policy, which is incorporated into these Terms by reference. By downloading, accessing, or creating an account on FitNova, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility & Age Requirements

To access or use FitNova, you must meet the following eligibility requirements:

• You must be at least 13 years old (or 16 years old for residents of the European Economic Area, UK, or jurisdictions with a higher minimum age of digital consent).
• If you are between the ages of 13 and 18, you must review these Terms with your parent or legal guardian to ensure both you and your guardian understand and agree to all terms.
• You must have the full legal capacity to enter into this binding agreement and must not be barred from using the Service under applicable laws.

2. Account Registration & Identity Protection

Certain features of the Service require you to register an account:

• Registration Options: You may register using your email address and a secure password, or through third-party authentication such as Sign-In with Google (OAuth).
• Accuracy of Biometrics: FitNova's AI algorithms calculate workout volumes, cardiovascular splits, and metabolic rates based on your inputted physical parameters (such as age, height, weight, gender, and experience level). Providing intentionally false biometric data can cause our algorithms to generate uncalibrated or strenuous workout and nutrition plans.
• Credential Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Identity Protection: Your private email address and login credentials are strictly hidden from all other users. Across all public workouts, social features, leaderboards, and chat conversations, you are identified solely by your unique chosen @username and display name.

4. User Safety & Exercise Responsibility

Physical exercise involves inherent risks of injury. When participating in workouts generated by or discovered on FitNova, you agree to exercise safely and responsibly:

• Listen to Your Body: Stop exercising immediately if you experience pain, dizziness, shortness of breath, nausea, or physical discomfort.
• Proper Technique & Warm-Up: You are solely responsible for ensuring proper exercise form, suitable equipment, adequate warm-up, and a safe physical environment.
• No Professional Supervision: FitNova does not supervise your exercise sessions. Proper execution, appropriate weight selection, and physical safety remain your sole responsibility.

5. Description of Features & AI Capabilities

FitNova provides advanced personal wellness tools powered by algorithmic intelligence:

• Workout Engine & 300+ Exercise Library: Includes 60 to 70 prebuilt workouts, an extensive database of 300+ categorized exercises, and natural-language AI workout generation. AI recommendations are customized estimates based on user parameters, not guaranteed athletic outcomes.
• AI Food Vision Scanner & Private History: Uses machine vision to analyze food photos, estimate culinary country of origin, and calculate nutritional macros. Because culinary preparations vary, nutritional data consists of intelligent estimations. Users have full control and responsibility to verify, review, and edit extracted calories and macros before saving items to their personal meal journal.
• 1-Click Workout-Linked Diet Plans & Meals Library: Generates tailored nutritional splits aligned with active workout intensity (pre-workout, post-workout, recovery macros) and provides access to an extensive meals database. Users with severe food allergies must independently verify meal ingredients before consumption.
• End-to-End Encrypted Chat: Secure peer-to-peer messaging using dynamic per-message cryptographic keys. FitNova has zero visibility into your private communications.
• Leaderboards & Gamification: Dynamically calculates activity points for completed workouts, ranking users on Country and Global Leaderboards. Approximate country is derived from profile selection or network country with zero precise GPS tracking.

6. User-Generated Content, Public Workouts & Cloning Rights

FitNova enables users to create, customize, and share fitness routines and communications:

• Ownership: You retain ownership of the original text, workouts, and content you create and submit to the Service.
• Public vs. Private Workouts:

  • Private Workouts: Workouts designated as "Private" are strictly confidential and accessible solely by your authenticated account.
  • Public Workouts & Cloning License: When you publish a workout as "Public", you grant FitNova and all FitNova community members a non-exclusive, worldwide, royalty-free license to view, like, save, share, and clone your workout routine. When a user clones your workout, an independent copy is created in their account library while preserving creator attribution to your public @username. You can revert any workout to "Private" at any time to remove it from community discovery.

• Content Warranties: You represent and warrant that your public workouts, display names, and shared content do not infringe any third-party intellectual property rights, do not promote dangerous or reckless exercise practices, and comply with all applicable laws.

7. User Conduct & Zero-Tolerance Safety Rules

Users must interact courteously and responsibly. You agree not to send, post, or transmit content that:

• Harasses, bullies, threatens, stalks, or abuses other users (Zero Tolerance: harassment, hate speech, or the promotion of self-harm or eating disorders will result in immediate and permanent account termination without refund).
• Contains sexually explicit, pornographic, violent, or obscene material.
• Promotes illegal activities, fraud, phishing, or deceptive commercial solicitations.
• Attempts to manipulate Leaderboard integrity by falsifying workout logs or manipulating activity metrics.
• Attempts to intercept, reverse engineer, or circumvent end-to-end encryption protocols.

In-App Safety Tools: In compliance with app store and play store safety standards and platform policies, FitNova provides prominent in-app tools allowing users to Block any abusive user and Report objectionable content directly from within any chat or user profile. When a report is filed, the reporting user client-side forwards the specific reported snippet to our safety moderation team to investigate and take prompt enforcement action.

8. Prohibited Platform Activities

You agree not to engage in any of the following unauthorized activities:

• Decompiling, reverse engineering, disassembling, or attempting to derive the source code of the App.
• Using automated scripts, bots, spiders, or scrapers to extract data from our exercise library, meal databases, or user profiles.
• Interfering with, disrupting, or imposing an unreasonable load on our backend servers and cloud infrastructure.
• Creating multiple fraudulent accounts or attempting to access unauthorized accounts.

9. Intellectual Property Rights

All intellectual property rights in the Service—including the FitNova name, logo, branding, visual designs, software code, 300+ exercise library database, UI graphics, and AI algorithmic architectures—are owned by FitNova or our licensors. Except for the limited personal license granted in these Terms, no rights or licenses are transferred to you.

10. Membership Tiers, Subscriptions & Billing

FitNova offers three membership tiers:

• Free Tier: Basic access to prebuilt workouts, the 300+ exercise library, and core activity logs.
• Pro Tier: Advanced AI workout generation, active workout-linked diet plans, and enhanced nutrition logs.
• Elite Tier: Unlimited AI food scans, advanced progress analytics, and specialized programming.

Billing & Auto-Renewal Terms

All subscription payments, upgrades, and renewals are handled directly through Apple App Store In-App Purchases (StoreKit) or Google Play In-App Billing. FitNova does not collect, process, or store credit card numbers or financial account credentials.

• Auto-Renewal: Paid subscriptions automatically renew for consecutive billing periods (e.g., monthly or annually) unless canceled by you at least 24 hours before the end of the current billing cycle.
• Managing & Canceling Subscriptions: You can manage or cancel your subscription at any time directly through your device settings:

  • iOS (Apple): Open Settings → tap your Apple ID profile → Subscriptions → FitNova → Cancel Subscription.
  • Android (Google Play): Open Google Play Store → tap your profile icon → Payments & subscriptions → Subscriptions → FitNova → Cancel Subscription.

• Free Trials: If a free trial is offered, you will not be charged during the trial period. Unless canceled at least 24 hours prior to trial expiration, the subscription will automatically convert to the chosen paid tier.
• Refunds: Because payments are processed by Apple and Google, refund requests must be submitted directly to the respective store provider in accordance with their refund policies. FitNova does not directly process subscription refunds.

11. Account Deletion & Data Purge

You can permanently delete your account and personal data at any time:

• In-App Deletion: Go to Settings → Account → Delete Account directly inside the FitNova app. Alternatively, you may email support@fitnovaapp.com with the subject line "Account Deletion Request".
• Immediate Deletion: Upon confirmation, your profile data, workout routines, nutrition logs, stored meal history photos, and chat metadata are permanently deleted from our active databases.
• Important Subscription Warning: Deleting your in-app FitNova account does NOT automatically cancel active subscriptions billed through Apple or Google Play. You must cancel your subscription in your device's app store settings before deleting your account to avoid recurring charges.

12. Apple App Store Minimum Terms (EULA Compliance)

If you downloaded the FitNova mobile application from the Apple App Store, you acknowledge and agree to the following mandatory Apple terms:

• Acknowledgement: These Terms are concluded between you and FitNova only, and not with Apple Inc. FitNova, not Apple, is solely responsible for the Licensed Application and its content.
• Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and Support: FitNova is solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
• Warranty: FitNova is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Product Claims: You acknowledge that FitNova, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, and regulatory conformity claims.
• Intellectual Property Claims: In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, FitNova, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal Compliance: You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Limitation of Liability

To the maximum extent permitted by applicable law, FitNova, its developers, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use of or inability to use the Service;
• Physical injury, illness, strain, or health complications resulting from workouts or dietary recommendations;
• Any estimation inaccuracies in AI-generated workout routines, meal plans, or food scan macro analyses;
• Unauthorized access, alteration, or interception of your communications by third parties outside of our reasonable control;
• Conduct, statements, or shared content of any other user of the Service.

14. Indemnification

You agree to defend, indemnify, and hold harmless FitNova and its operators from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms, your misuse of the Service, or your public user-generated content.

15. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

16. Governing Law, Dispute Resolution & Severability

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted in the appropriate courts of competent jurisdiction.

Severability & Entire Agreement: If any provision of these Terms is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision shall be limited or severed to the minimum extent necessary, and shall not affect the validity and enforceability of the remaining provisions. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitNova governing your use of the Service.

17. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. When modifications are made, we will update the "Last Updated" date at the top of this document. Material changes will be communicated via in-app notification or email prior to taking effect. Your continued use of the Service following posted changes constitutes acceptance of the modified Terms.
